- Welcome to the Schooling Online Website (“Site”). Schooling Online delivers online video content (“Digital Content”) to childcare centres and schools among others (our “Subscribers”) for the training and education of children and students (our “Subscription Services”).
- In this Privacy Policy, “we”, “our,” or “us” means Avenir Education Pty Ltd (ACN 617 250 834). Any reference to “you” or “your” means you, as a Subscriber for the Subscription Services.
- Please read this Privacy Policy before using our Site because it will tell you how we collect, store, use and disclose your personal information when you register as a Subscriber or otherwise access the Site.
- This Privacy Policy complies with our obligations as set out under the Australian Privacy Principles (“APPs”) in the Australian Privacy Act 1998 (Cth) (“Privacy Act”) and will give you an understanding of:
- the types of personal and non-personal information we collect;
- how and when we collect, use, store, disclose and otherwise handle personal information;
- the purposes for which we collect, use, and disclose personal information;

- Information we collect
- When you browse, use, or access our Site, we may automatically receive, collect, and record information about you, whether through the Site directly or by other means.
- To provide you with our Subscription Services, we collect your personal information and non-personal information. Collectively this information is called your subscriber information (“Subscriber Information”).
- Personal Information
- Personal information is information that we collect and use to identify our Subscribers when they register for our Subscription Services on the Site and includes information about an individual from which the individual’s identity is apparent or can be readily identified from the information.
- The personal information we collect from users that access the Subscription Services may include, but is not limited to your:
- name (or the name associated with your Subscription);

- telephone number;
- financial details;
- username and password (“Login Information”).
- Non-Personal Information
- Non-personal information is information about you or your activities which cannot be used to personally identify you. We may collect non-personal information when you browse, use, or access our Site.
- This non-personal information may include, but is not limited to usage analytics, URLS, traffic data, IP addresses or other data that is collected to monitor how a user accesses our Site.

- We use the personal information you provide us to carry out our rights and perform our obligations arising from any contracts entered between you and us.
- We use your personal information for billing purposes including where we use third-party payment providers to process payments that are made for our Subscription Services. Third-party payment providers may collect and use any information you have supplied to them through the payment of our subscription fees, which may include non-financial information such as email address, billing address, and the Subscriptions Services purchased. You should read the privacy policy of any relevant payment provider that you use for any purchase in connection with our Site. Please note that any payment you make with a third-party payment provider is subject to the terms and conditions of that third-party payment provider.
- We use your personal information to deliver notifications to your subscriber account (“Subscriber Account”) or your email in relation to new digital content offered through the Subscription Services (“Digital Content”), offers and promotions (from us or third-parties), changes to your Subscription Services, feedback, new products or services, and to respond to your inquiries. You can change how you receive these notifications by changing your Subscriber Account settings or by opting-out, whichever is applicable.
- We may, with your consent, collect personal information about you for the purpose of marketing other services which we think may be of interest to you, or for obtaining your feedback. For example, we may send you emails regarding your subscription, notifications and messages (e.g., updates of our Terms, Subscription Account changes, confirmation of your Subscription, changes/updates to features of our Subscription Services and this Privacy Policy, and technical and security notices).
- We will not disclose your personal information to third-parties without your express written permission or as otherwise stated in this Privacy Policy. You agree and acknowledge that we may disclose your personal information according to this Privacy Policy and you consent to us disclosing your personal information to the following parties (either in or outside Australia), when:
- they are our employees, officers, directors, agents, business partners or joint venture entities or partners who are required to follow data privacy laws and security policies when handling personal information;
- they are entities providing services to us including legal services, financial services, data providers, storage services and mailing houses;

- In accordance with the APPs, we are required to correct our records of personal information if they are inaccurate, out-of-date, incomplete or misleading. If your personal information changes, please update your Subscription Account in the Site to reflect the change or Contact Us to update your records.
- Data Ownership
- You as a Subscriber for the Subscription Services as provided and facilitated to you through our Site own all right, title and interest in your personal information, Login Information, and any other information associated with your Subscriber Account that you provide to us (“Subscriber Data”). You are solely responsible for the accuracy, quality, legality, integrity, reliability and appropriateness of your Subscriber Data.
- You grant us a perpetual, worldwide, exclusive, fully paid-up and royalty-free, unlimited, irrevocable, sub-licensable and transferable licence whilst you are an active Subscriber to our Subscription Services to use, copy, transmit and store your Subscriber Data in accordance with this Privacy Policy and our Terms.
- Avenir Education Pty Ltd and any related entities own all right, title and interest in any data or information that we create, generate, compile, derive, or produce in connection with the Site or the Subscription Services, including data and information that is:
- aggregate or raw or statistical r
- elating to usage, analyses and results of the Site or the Subscription Services;
- for the purpose of optimising delivery, commercialisation and performance of our Site and our Subscription Services; and

- We may share and make available your Subscriber Information or Subscriber Data with third-party service providers for the following purposes:

- optimising the Site or the Subscription Services;

- It is important that you keep your Subscriber Account secure with your Login Information. You must not give your Login Information to any other person. You must notify us immediately if you are aware, or believe, that someone other than yourself without authorisation has access to your Subscriber Account. You should also take measures, such as changing your Login Information regularly, so that your Subscriber Account is secure.
- While we take precautions against possible security breaches of our Site and servers, no site or Internet transmission is completely secure. You acknowledge that we are not responsible for the privacy or security practices of any third-party (including third-parties that we are permitted to disclose your personal information to in accordance with this Privacy Policy or any applicable laws). The collection and use of your information by such third-parties may be subject to separate privacy and security policies.
- You also acknowledge that the security of communications sent by electronic means or by post cannot be guaranteed. You provide information to us via the Internet or by post at your own risk. You as a Subscriber are legally responsible for the security of and access of any user to your own device and our Subscription Services. We encourage you to keep regular backups of all your Subscriber Information and Subscriber Data. If you suspect any misuse or loss of, or unauthorised access to your personal information or any other privacy breach, please let us know immediately.
- Disclaimer and Limitation of Liability
- Your use of our Site is at your own risk. The Site is provided on an “as is” basis.
- We will take all reasonable steps to keep your personal information secure but to the maximum extent permitted by law, we exclude all liability for the consequences of any unauthorised access to your Subscriber Information and Subscriber Data. This includes (but is not limited to) loss or damage you might suffer because of any of the following:
- reliance on the completeness, accuracy, suitability or currency of the Site (including third-party material and advertisements);

- the provision of credit card or other financial information, the failure to complete (or delay in completing) any transaction, or other loss or damage arising from any e-commerce transacted or attempted to be transacted on the Site.
- We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site or the Subscription Services will be uninterrupted or free from error or that any defects on the Site will be corrected or that the Site or servers are free of viruses or other harmful conditions or components.
- To the extent permitted by law, we disclaim liability, whether based in contract, tort, negligence, strict liability or otherwise, for damages of any kind (including, but not limited to, direct, indirect, incidental, consequential, special, punitive or exemplary damages) in any way arising from the functionality, operation or the information provided by the Site including but not limited to damages arising from interruptions of service or delays in operation or transmission even if we are expressly advised of the possibility of such damages.
- Law and Jurisdiction
- Please be aware that your Subscriber Information and Subscriber Data will be stored and processed in Australia where we engage service providers.
- This Privacy Policy is governed by and construed in accordance with Australian law. You irrevocably submit to the non-exclusive jurisdiction of the Courts of New South Wales Australia and any court that may hear appeals from any of those courts for determining any dispute concerning this Privacy Policy and waive any right you may have to claim that those courts are an inconvenient forum.
- Changes to your Personal Information
- The Privacy Act requires us to correct our personal records of Subscribers if they are inaccurate or outdated. Please update your records and your Subscriber Account via the Site, or by Contacting Us and providing your updated information.
- Please be aware that you may need to provide proof of identity before we can change your records or update your details. We may refuse to provide you with certain information where permitted or required by law.
- Opting-Out
- If we use your personal information to market and promote our Subscription Services or related products or services, you may notify us at any time that you do not wish to receive marketing or promotional material by contacting us directly or through the “unsubscribe” mechanism in our marketing or promotional emails.
